The North American medical and recreational cannabis markets grew to over $12 billion in 2018, up by 30% on the year. The largest market was in the United States, which totaled $10.4 billion. By 2021, analysts predict the overall North America cannabis market for legal adult-use and medical sales to reach $24.5 billon. Oklahoma alone has now approved licenses for over 2,200 dispensaries, nearly 1,200 cannabis processors, and 4,287 growers. Marijuana Business Facebook estimates that Oklahoma medical marijuana sales will hit $140-180 million in 2019, far exceeding original projections.

As the demand for medical cannabis and the access to marijuana continues to grow (compounded annual growth rate is nearly 28% nationwide), many Oklahomans have begun to wonder how they can get involved in the cannabis industry and cement their mark as a cultivator, processor, or retail dispensary.

When considering this endeavor, it is important to remember that every state has different marijuana laws- they are regulated by state, not federal law. While some states allow marijuana for recreational and medical use, some states only allow medical use, and some only allow certain low THC products for medical use (CBD). Most states limit the number of licenses they will grant and the window to apply for them. You should also understand that getting licensed is never simple — there are very specific requirements and guidelines that differ by state and its usually highly competitive, which is why most successful applicants and individuals work with business consultants and experienced cannabis advocates like Diver Law Firm to help guide them through this delicate process.

In Oklahoma, there are also several new compliance-related rule changes that target cultivators/growers, processors, dispensaries, and individuals with transporter licenses. For instance, the timeline for business application processing will now be 90 days with a 30 day response for rejected applications. There are also stricter residency requirements, which include proof of residency for that last two years preceding the date of renewal or application or five continuous years of the last 25 years preceding the date of renewal or application, in order to establish that 75% of the owners are Oklahoma residents as required by law. OMMA will also require all business license holders submit a Certificate of Compliance to the political subdivision that has jurisdiction where the business is located. It is crucial you know that the new compliance standards are far more rigorous than the initial rollout of SQ 788. OMMA will verify that every requirement listed in 63 O.S. § 427.2 is noted as not applicable, including zoning classifications and ordinances, safety codes, fire codes, electrical, plumbing, and waste codes, building or construction codes, and that no other ordinances/requirements are applicable to the applicant.
